Negotiating a commercial lease
Taking on a commercial lease is usually a major undertaking for a business. There are a substantial number of points to be addressed when agreeing the terms of the lease and it is vital for both the landlord and tenant that these are appropriate for the situation.

Assigning, transferring or subletting a commercial lease
Where a tenant no longer wishes to occupy commercial premises, the lease may permit them to assign, transfer or sublet to a new tenant. The lease will contain conditions that will need to be adhered to, for example, obtaining the landlord’s consent.

We can ensure that the right documentation is drawn up for the assignment, transfer or subletting, to protect your interests as far as possible. 

Commercial lease solicitors and lawyers - renewal
You may have security of tenure under the Landlord and Tenant Act 1954 or this may have been specifically excluded in the terms of the lease. If you have security of tenure, you have a statutory right to renew your lease, although you will need to negotiate and agree terms with your landlord.

Where you do not have security of tenure, you may still be able to agree a new lease if this is acceptable to your landlord.

We can notify your landlord of your wish to renew your lease, which should be done 6-12 months before it expires, and negotiate on your behalf to agree a new lease. If you have the right to renew, but you cannot agree with your landlord, we can represent you in an application to the court for an order setting out new terms. We will ensure that the correct process is followed, to include serving notice in accordance with the law.

Commercial lease surrender
Where a landlord and tenant come to an agreement for the tenant to surrender the tenancy, it is important that this is properly documented. If the tenant is no longer able to afford the rent and wishes to leave, or needs larger premises to expand, then the landlord may be prepared to agree a deal releasing the tenant from their obligations. Surrender is only possible where both parties are in agreement.

We can draw up a deed of surrender on your behalf, dealing with issues such as compensation for loss of future rent or refund of rent paid in advance, details of any premium that is to be paid by either party in return for the surrender and any agreement that is reached over obligations in respect of work that is required to the property to put it into a good condition. 

Commercial lease dispute resolution
Because commercial leases are complex and contain numerous liabilities, disagreements may arise over time. It is advisable to seek legal help as soon as possible to try and resolve matters before the situation deteriorates.
